Summary: IndiLearn tools are in active development. The v1 pilot is free. IndiLearn does not assign grades or replace teacher professional judgment. Student data is never used for AI model training. All AI-generated feedback is a tool to support — not substitute for — the teacher's professional assessment of student work.
1. Acceptance of terms
By accessing indilearn.com.au or using any IndiLearn product, you agree to these Terms of Use. These terms form a binding agreement between you (or, in the case of a school, the school as an organisation) and IndiLearn Pty Ltd ("IndiLearn", "we", "us").
If you are accessing IndiLearn tools on behalf of a school, you represent that you have authority to bind the school to these terms.
2. About IndiLearn products
IndiLearn currently offers two products in development:
- IndiLearn Phonics Reading App — a structured literacy tool for Prep to Year 2 students, providing phoneme assessment and decodable content generation.
- IndiLearn Feedback Platform — an AI-powered tool that generates individualised written feedback on student work against teacher-defined success criteria.
Both products are in active development. Features, functionality, pricing, and availability may change. IndiLearn will notify pilot participants of material changes by email.
3. Pilot programme terms
The v1 pilot programme is provided free of charge to founding school participants. The following conditions apply to pilot participation:
- Pilot participation is by invitation and subject to availability.
- IndiLearn may end or modify the pilot programme at any time with reasonable notice to participants.
- Pilot participants agree to provide good-faith feedback on the tools to help IndiLearn improve the products.
- IndiLearn makes no warranty regarding the availability, reliability, or performance of pilot software.
- Pilot schools are responsible for obtaining any required approvals from their education department for participation.
4. What IndiLearn does not do
These limitations are not legal disclaimers — they are design commitments:
- IndiLearn does not assign A–E grades or equivalent assessments. The feedback platform generates qualitative feedback (strength, next-step, example) anchored to teacher-defined success criteria. Grading remains the teacher's professional judgment.
- IndiLearn does not make decisions about student progress, promotion, or retention. All IndiLearn outputs are tools to inform, not replace, teacher professional judgment.
- IndiLearn does not train AI models on student data. No student work, assessment data, or feedback is used for any AI training purpose under any circumstances.
- IndiLearn does not provide medical, therapeutic, or diagnostic assessments. The phonics app provides educational assessment of phoneme production for instructional purposes. It is not a speech pathology tool and does not diagnose speech or language disorders.
5. Acceptable use
Users of IndiLearn tools agree to:
- Use the tools only for their intended educational purpose in school settings.
- Not attempt to reverse engineer, decompile, or extract model weights or proprietary algorithms from IndiLearn products.
- Not use IndiLearn tools to process data in violation of applicable privacy laws or their school's data governance policies.
- Not attempt to circumvent any security controls or access controls in IndiLearn products.
- Report any security vulnerabilities discovered to security@indilearn.com.au rather than disclosing them publicly.
6. Intellectual property
IndiLearn Pty Ltd owns all intellectual property rights in IndiLearn products, including:
- The proprietary speech recognition neural engine for phoneme assessment.
- The multi-algorithm handwriting scoring system (PencilKit integration).
- The CoachingProvider abstraction layer and its implementations.
- All software, code, models, and documentation.
- The IndiLearn brand, name, and logo.
Schools and teachers retain ownership of all materials they upload to IndiLearn, including rubrics, unit plans, success criteria, and student work. IndiLearn does not claim any rights over school-provided content.
Feedback generated by IndiLearn tools for a specific student's work may be used by the school for educational purposes without restriction. IndiLearn does not claim intellectual property rights over generated feedback content.
7. Privacy
IndiLearn's handling of personal information is governed by our Privacy Policy, which forms part of these Terms of Use. By using IndiLearn tools, you agree to the Privacy Policy.
Schools using IndiLearn are responsible for compliance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and any applicable state education department data governance policies in connection with their use of IndiLearn tools.
8. Data and the on-premise architecture
In IndiLearn's on-premise deployment, all student data is processed on school-owned hardware within the school network. IndiLearn does not access, receive, or store student data from on-premise deployments. The school is the data controller.
In the cloud deployment (v1 pilot only), IndiLearn processes student work through its Cloudflare Worker proxy for AI inference. This data is not retained beyond immediate processing. Schools must comply with their education department's requirements for obtaining parental consent before using the cloud deployment path.
9. Limitation of liability
To the maximum extent permitted by Australian law:
- IndiLearn provides its products on an "as is" and "as available" basis during the pilot phase.
- IndiLearn does not warrant that its products will be error-free, uninterrupted, or free from security vulnerabilities.
- IndiLearn's liability for any claim arising from use of its products is limited to the amount paid by the school for the product in the preceding 12 months. For pilot participants (who pay nothing), this limit is AU$0, but IndiLearn remains liable for gross negligence, fraud, and liability that cannot be excluded by law.
- IndiLearn is not liable for any reliance by teachers or schools on AI-generated feedback for consequential educational decisions. All IndiLearn outputs are advisory and professional judgment must be applied.
Nothing in these terms limits or excludes any rights under the Australian Consumer Law that cannot be excluded.
10. Governing law
These Terms of Use are governed by the laws of Queensland, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of Queensland courts.
11. Changes to these terms
IndiLearn may update these Terms of Use from time to time. We will notify pilot school contacts of material changes by email with at least 14 days' notice before the changes take effect. Continued use of IndiLearn products after the notice period constitutes acceptance of the updated terms.
